Hereinafter referred to as the “Seller”, while the visitors/customers of the website are referred to as “Users/Buyers”.

Use of the Website and placing orders imply full acceptance of these Terms and Conditions. We reserve the right to update them without prior notice; the applicable version is the one displayed on this page at the date of use.

1. Definitions

Website / Platform: www.cutiecraft.ro and its related subdomains.

Account: the secure space created using an email address and password, containing your personal data and order history.

Goods / Products: DIY boxes and related items presented on the Website, along with the associated documentation.

Order: the electronic request submitted by the Buyer for the purchase of one or more Products.

Distance Contract: the order confirmed by the Seller, as defined under Government Ordinance 34/2014.

Review / Rating: the evaluation and score (1–5 stars) provided for a product after purchase.

Document: this set of Terms and Conditions.

2. Pre-contractual Information

Before completing an order, we provide clear and easily accessible information about:
product characteristics, total prices (including VAT and delivery costs), payment methods, delivery timeframes, right of withdrawal and applicable exceptions, contract language (Romanian), and offer duration — in compliance with Government Ordinance 34/2014 and Law 365/2002.

3. How the Contract Is Formed

Simple steps: add products to cart → fill in your details → choose a payment method → confirm that you have read the Terms → place the order.
The contract is considered concluded once you receive our order confirmation/shipping email.
Until that moment, the Seller may refuse or adjust the order (e.g., due to out-of-stock items), with prior notice to the Buyer and, if applicable, prompt refund of any paid amounts.

4. Online Sales Policy

The Website is open to any adult User.
We reserve the right to restrict access to certain payment methods or to block accounts in justified cases (fraud, abuse, conduct harmful to the Seller).
We may publish temporary promotions, valid for the announced period and within available stock limits.

5. Prices, Taxes, and Payment Methods

All prices are expressed in RON and include VAT. Prices may change without notice; however, changes do not affect already confirmed orders.

Accepted payment methods:

  • Online card payment via Netopia Payments (card details are processed by Netopia and not stored by us);

  • Cash on delivery (COD) via Sameday;

  • Bank transfer (if listed at checkout).

Any bank or currency conversion fees are borne by the Buyer.

6. Products, Customization, and Availability

Product descriptions and images are for informational purposes; minor differences in color/finish may occur depending on screen settings or production batches.
Some products allow customization options (e.g., box color selection). For such products, the return exception in Article 18.1 applies.
Stock status (“in stock”) is indicative; in case of unavailability, we will notify you and either refund your payment or offer alternatives.

7. Delivery and Transfer of Risk

Delivery is made exclusively within Romania via Sameday.
Estimated time: 1–3 business days from confirmation (may increase during peak periods or for made-to-order products).
Standard cost: 15 RON; free delivery for orders ≥ 250 RON.
Risk transfers to the Buyer upon delivery to the courier or Buyer, when signing the transport document. The courier is not authorized to allow package opening before signature.

8. Packaging, Receipt, and Transport Incidents

Orders are shipped in protective packaging. Upon delivery, please visually inspect the parcel in the courier’s presence; if any damage is visible, request a damage report.
Without this document, resolving transport-related claims may be delayed or denied.

9. Right of Withdrawal (Return) – 14 Days

You have the right to withdraw from the contract within 14 calendar days from receipt of the product, without giving any reason.
You can notify us at suport@cutiecraft.ro (you may also use the EU standard withdrawal form).

Conditions: the product must be unused, preferably in its original packaging, with all accessories/tags/gifts/documents included.

Refunds are issued within 14 days of notification, but we may delay until receipt of the returned goods or proof of return shipment (whichever occurs later).

Refund method: same as payment (card → card, or bank transfer for COD/transfer orders); alternatively, a voucher if you choose so.

If the product’s condition is diminished (traces of use, missing accessories), we may apply a value reduction (typically 5–50%, depending on the findings).

10. Exceptions to Withdrawal (Art. 16 of GO 34/2014)

Returns are not accepted for personalized products (e.g., boxes customized by the Buyer’s color choice or made-to-order items).
We reserve the right to refuse abusive returns (unjustified repeated returns).

11. Warranty and Conformity

Products are compliant with their published descriptions.
If you receive a defective or non-conforming product, contact us at suport@cutiecraft.ro with photos and your order number.
We will remedy the issue through repair/replacement or refund, in accordance with applicable consumer protection laws.

12. Invoicing and Documentation

Invoices are issued electronically and sent to the email address provided with the order.
Please keep your invoice and order confirmation for any future claims or inquiries.

13. Reviews and User-Generated Content

By posting a review, you grant us a non-exclusive, irrevocable, worldwide license to use the content (reproduce, publish, adapt) for product presentation and marketing purposes.

Rules: appropriate language, truthful information, no hidden advertising, and no copyright infringements.
Repeated violations may result in review-posting restrictions.

14. Intellectual Property Rights

All content on the Website (texts, images, graphics, trademarks, design elements, code) belongs to the Seller or its partners/licensors and is protected by applicable laws.
Use of this content for purposes other than personal, non-commercial ones is prohibited without prior written consent from the Seller.
Short citations (up to 400 characters) are permitted with proper source attribution and link to the Website.

15. Limitation of Liability

The Website may contain incomplete or incorrect information or may be temporarily unavailable. Use is “as is.”
We are not liable for:

  • minor color/finish variations;

  • delivery delays caused by couriers;

  • indirect losses;

  • external links;

  • technical interruptions beyond our control.

The maximum liability toward a customer shall not exceed the total amount paid for the respective order.

16. Newsletters and Accounts

You may subscribe to our newsletter and unsubscribe anytime via the link in the email.
For security, do not share your account password and log out after each session.

17. Promotions and Discounts

Our promotions are valid during the announced period and within stock limits.
We may modify or discontinue a campaign, with effect only for future orders (confirmed orders are not affected).

18. Cancellations and Special Situations

We may cancel an order, with prior notice, in cases of:
obvious pricing/description errors, fraud, delivery impossibility, or unpaid transfers.
If you have already paid, all amounts will be fully refunded without undue delay.

19. Personal Data Protection (GDPR)

Your personal data is processed in accordance with our Privacy Policy, available in the footer.
This policy explains the legal basis, purposes, recipients (e.g., Netopia – payments, Sameday – delivery), retention periods, and your rights (access, rectification, erasure, objection, portability).

20. Cookies and Similar Technologies

We use cookies for functionality and analytics (e.g., Google Analytics / Meta Pixel, if active).

21. Complaints and Dispute Resolution

For complaints: suport@cutiecraft.ro – we respond within 30 calendar days.
Consumers may also use the European ODR platform: https://ec.europa.eu/consumers/odr.
We aim to resolve all disputes amicably.

22. Force Majeure

Neither party shall be held liable for failure to perform obligations caused by force majeure events, as defined by law.

23. Governing Law and Jurisdiction

This document is governed by Romanian law.
Disputes will be settled by the competent courts of Romania, after a prior attempt at amicable resolution.

24. Amendments to the Terms

We may update this page at any time. The version and date of the last update are displayed in the header.
Continued use of the Website after such updates constitutes acceptance of the revised Terms.
